The order by the Customer implies the acceptance of these general conditions in their entirety.

Our offers are aimed at consumers over the age of 18. If you are under 18 years of age, you are not permitted to use the E-Phoenix.CH website and its products and services. Items visible on the website are available while stocks last. Offers and prices are guaranteed to be valid within 8 days.

In the event of a debit or collection for the order of an unavailable item, E-Phoenix.CH, undertakes to offer a credit note or to reimburse the customer within 30 days. E-Phoenix.CH, commits itself to inform by e-mail the customer who would have ordered an unavailable item.

The products offered for sale are those described on the site. The company E-Phoenix takes the greatest care in the presentation and description of its products in order to best satisfy the customer’s information. It is however possible that non-substantial errors may appear on the site, which the customer acknowledges and accepts.

In any case, in the event of non-conformity of the product delivered in relation to its description on the site, the customer can either exercise his right of retraction or implement the guarantee of conformity of the company E-Phoenix which will proceed, if necessary, either to the exchange or to the refund of the price (in whole or part) possibly invoiced.

Prices are invoiced inclusive of all taxes (including 7.7% Swiss VAT). We reserve the right to change our prices at any time without prior information, but products are invoiced at the price at the time of the purchase order.

The customer validates his order as described below. This validation implies acceptance of these general terms and conditions of sale. The customer interested in an article visible on the E-Phoenix site follows the following process in order to establish his order. After having clicked on the “confirm” icon and after having checked the specifics of his order (colour, quantity, product, price, etc…), the customer validates the choice of the selected product(s) by a click. If the customer benefits from a special offer, he must first enter a code that will have been assigned to him in the field provided for this purpose. For his first order, the customer has a form to fill in containing the following information: title, surname, first name, full delivery address, email, date of birth, telephone number. On this occasion the customer creates his password. The customer has the option to pay by credit card directly on the site. After validating his method of payment, the customer definitively and irrevocably validates his order with the effects indicated below.

Payment by credit card on the site: The customer validates his delivery and billing address, the product and the total price. He provides his bank card number associated with the expiry date and the CVX code. He finally validates his order by clicking on the “Confirm” button.

E-Phoenix reserves the right to refuse to make a delivery or to honour an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is in progress.

E-Phoenix controls all orders that have been validated on its site. These controls aim to protect E-Phoenix from abusive practices operated by fraudsters. Our services may ask you for all the documents necessary to unblock your order: proof of address or debit in your name, or proof of address in the name of the person indicated for the delivery address, etc. These requests will be made by e-mail: – For an order with a different delivery address from the billing address – For new customers – For an order over 150 Euros.

In order to ensure the security of payments, the E-Phoenix site uses the secure payment service of the Post Office. This service integrates the SSL security standard. Confidential data (16-digit credit card number, expiry date, CVX code) are directly transmitted encrypted to the post office server without transiting on the physical supports of the E-Phoenix server.

When the order is validated: The payment request is routed in real time to the secure telepayment manager. The latter sends an authorisation request to the credit card network. The telepayment manager issues an electronic certificate which will be used as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the civil code.

You can also carry out secure transactions from, Swiss Post and by bank transfer.

Customers who have already made a purchase on the E-Phoenix site can choose a password so that they do not have to fill in the forms again when placing an order. The customer who has already registered is recognised on the site as a customer of E-Phoenix. The password of the E-Phoenix customer is strictly confidential and personal. Under no circumstances may it be divulged or communicated to anyone.

Should the E-Phoenix client lose or forget his password, it is incumbent upon him to inform the E-Phoenix site manager at info@e-phoenix.ch as soon as possible. Within 48 hours, the E-Phoenix site manager will issue him with a new password which will automatically replace the old one. In order to facilitate the identification of the customer by the simultaneous supply of the e-mail address and the password, the customer expressly authorises E-Phoenix to deposit on the customer’s hard disk a file known as a “cookie” whose sole purpose is to facilitate the said identification.

In the event of delivery of a defective product, E-Phoenix products benefit from a guarantee as follows:

E-Phoenix products, including and limited to: battery, USB charger, USB cable, wall adapter, charging box are under warranty for a period of 3 months from the date of purchase. This excludes natural deterioration due to use of the product. Defective products will either be repaired or exchanged.

The cartridges, atomisers and sprayers are consumable parts and therefore do not benefit from any guarantee.

The products will be delivered within a maximum of 24 working hours if the order is valid before 11am on the day of dispatch, and if there is no Fedex slowdown. Average delivery time: 24/48 hours

Important:
The delivery of the products remains the responsibility of the buyer. We entrust orders to Fedex. A tracking number will be sent to you. We recommend that you contact Fedex to check that your package is being delivered and to look for the causes of any problems that may have occurred during delivery. If Fedex is unable to deliver the order to the address you have given us, it is your responsibility to go to the distribution centre to collect your order, or to call Fedex to re-route the delivery to the address of your choice.

By reading this document, you agree to take full responsibility for the use you make of the product ordered on E-Phoenix. Some e-liquids sold on the E-Phoenix website contain nicotine, and all of them contain propylene glycol, vegetable glycerine and food flavourings. It is strongly recommended that you consult your doctor before using the e-liquids sold on E-Phoenix.

The effects of nicotine can be stimulation, a feeling of relaxation, tranquillity or alertness. The carcinogenic properties of nicotine, separate from inhalation via tobacco, are not yet evaluated by the International Agency for Research on Cancer.

The batteries of electronic cigarettes can cause electric discharges and the inhalation of the vapour of e-liquids can in some cases cause suffocation. If you have any problems, consult your doctor immediately.

All E-Phoenix products without exception should be kept out of the reach of children.

E-Phoenix cannot be held responsible for any injury, loss or allergic reaction that may occur as a result of the use of its products.

E-Phoenix sàrl has only an obligation of means for all stages of access to the site, consultation, filling in forms, placing orders, delivery of articles or any other service.

Consequently, E-Phoenix cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network and totally outside the diligence and precautions taken by E-Phoenix. In particular, any disturbance in the provision of the service, or any external intrusion or presence of computer virus, cannot engage the responsibility of E-Phoenix.

Likewise, any fact qualified as force majeure within the meaning of the jurisprudence of the Court of Cassation totally exonerates E-Phoenix from any liability.

All elements of the E-Phoenix site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of E-Phoenix. Any hypertext link to the E-Phoenix site using framing, deep-linking, in-line linking or any other deep-linking technique is in any case strictly prohibited.

In any case, any link, even tacitly authorised, must be removed upon request by E-Phoenix.

E-Phoenix, for the purposes of the service, reserves the right to collect nominative data relating to the users of the site, in particular by means of the “cookie” referred to in article 8. E-Phoenix also reserves the right to commercially transfer the data it has collected on its site.

In any case, and in accordance with the law n°78-17 of January 6, 1978, any user or customer of the site can at any time oppose the commercial use of the said data and also benefits from a right of access, rectification and deletion of the data concerning him/her.
